Polish government wants to adopt a project for the construction of houses without permission

The Polish government plans to adopt a project assuming the possibility of erecting residential buildings with a building area of ​​70 sqm based on the notification procedure, while the total maximum usable area for such buildings may not exceed 90 sqm, according to the list of legislative works and programs of the Council of Ministers.

The adoption by the Council of Ministers of the draft amendment to the Construction Law and the Act on spatial planning and development is planned for Q3.

The proposed regulation introduces the possibility of building single-family residential buildings without a building permit, without a construction log and without the need to appoint a construction manager, in the notification procedure. Already at the stage of consent for implementation, the subject of the notification, to which the construction design will be attached, is to be a building with an area of buildings up to 70 sqm with an attic, with a total usable area not exceeding 90 sqm, according an annoucement.

These facilities are supposed to be small and of simple structure, which is to facilitate compliance with safety requirements. At the same time, however, it is allowed for them to be two-storey, and the attic with rooms intended for people to stay is also considered a storey.

The proposed regulation assumes that in the absence of a local spatial development plan, the decision on development conditions for this type of facilities is to be issued within the deadline of 30 days.

In order to ensure a real shortening of the duration of the proceedings to issue a decision on development conditions, the draft provides for the introduction of a fine for exceeding the above a term imposed by a higher authority.

The project also provides for a change in the permissible development area of ​​free-standing one-story recreational buildings for periodic rest from the current 35 sqm to 70 sqm. In this case, it is planned to introduce a limitation so that the span of structural elements in such objects is not more than 6 m, and the reach of the brackets is limited to 2 m.
